Numbers show the labor market is healing, but slowly

WASHINGTON (Reuters) - The number of Americans filing new claims for unemployment benefits last week stayed in a range consistent with job growth and incomes rose in December by the most in eight years, mildly positive signs for a still-fragile economy.

The data suggests points to some underlying momentum in the economy despite a surprise contraction in gross domestic product during the fourth quarter, which largely came from temporary factors.

Last week, initial claims for state unemployment benefits increased 38,000 to 368,000, the Labor Department said on Thursday.

The increase follows a week where new claims were at their lowest in five years and still points to an economy where employers are adding jobs, albeit at a lackluster pace.

"It's still consistent with modest employment growth," said Sam Bullard, an economist at Wells Fargo Securities in Charlotte, North Carolina.

Economists polled by Reuters had expected claims to increase to 350,000.

Claims have been very volatile this month, dropping sharply in the week ended January 12 and maintaining the trend in the following week. That was largely because the model used by the department to smooth out the seasonal variations has been unusually generous during the first three weeks of January.

The four-week moving average for new claims, a better measure of labor market trends, gained 250 to 352,000, suggesting a steady improvement in labor market conditions.

Last week's claims data has no bearing on January's employment report, which is scheduled for release on Friday, as it falls outside the survey period.

Prices for U.S. 30-year Treasuries pared gains, while S&P 500 futures, which were flat to negative before the data, rose a little.

Employers are expected to have added 160,000 jobs to their payrolls in January after an increase of 155,000 in December. The unemployment rate is seen holding steady at 7.8 percent.

In a separate report, the Commerce Department said American incomes rose 2.6 percent last month. That was the biggest increase since December 2004 and well above analysts' expectations for a 0.8 percent gain.

However, much of the increases in personal incomes over the last two months have been due to special dividends and accelerated bonuses to beat tax increases that were due to begin this month.

The big rise in incomes suggests total consumer spending power entered the new year on a stronger footing, even if the gains may not have been distributed evenly throughout the workforce.

The economy faces the threat of across-the-board spending cuts scheduled for March, as well as the possibility the government might default later this later year and trigger another recession.

After-tax income climbed 2.7 percent in December, the strongest since May 2008, while consumer spending rose 0.2 percent, just below the pace expected by analysts in a Reuters poll.

Excluding the one-time factors that boosted incomes in December, after-tax income rose 0.4 percent.

Planned layoffs at U.S. firms fell in December for the first time in four months, while the overall job-cut total in 2012 was the lowest since 1997, a third report showed on Thursday.

Employers announced 32,556 job cuts last month, the second lowest monthly total of 2012 and down 43 percent from 57,081 in November, according to the report from consultants Challenger, Gray & Christmas, Inc.

NOAA forecasters say an unnamed extra-tropical storm will experience explosive intensification over the North Atlantic this weekend. Its central low pressure could rival a category 4 hurricane's.

Forecasters are predicting explosive intensification this weekend for an extra-tropical storm in the North Atlantic that is expected to eclipse the intensity of last October's superstorm Sandy.

Unlike Sandy, the nameless North Atlantic superstorm poses no threat to land. But it does highlight the power such storms can attain.

It's forecast to develop winds of up to 98 miles an hour, while the air pressure at its center ? expected to reach a low between 920 to 930 millibars ? would rival that of a category 4 hurricane, according to forecasters at the National Oceanic and Atmospheric Administration's Ocean Prediction Center in College Park, Md.

The system is the same storm "that gave us some snow a couple of days ago in DC," says Robert Banks, a forecaster at the Ocean Prediction Center. The storm intensified as the cold air moved out over relatively warm North Atlantic water, which is feeding energy into the system.

In addition, the system is merging with two other upper-level troughs ? providing the storm with yet more punch.

It's not clear how this storm will fare in the record books, Mr. Banks says. But over at the Weather Underground's web site, data gathered by British weather historian Stephen Burt shows five other storms between 1824 and 1986 with central pressures ranging from 920.2 to 925.6 millibars.

An extra-tropical superstorm in January 1993 holds the record for low pressure ? 913 millibars ? for North Atlantic winter storms in an event that destroyed an oil tanker after it ran aground at the Shetland Islands. The tanker, the MV Braer, was carrying 85,000 tons of crude oil.

Mixed decision in phony Scrolls email appeal

(AP) ? Evidence in a rare Internet impersonation case showed that a highly educated defendant broke the law by trying to "damage the careers and livelihoods" of scholars caught up in an academic debate about the Dead Sea Scrolls, a New York appeals court ruled in a mixed decision made public Wednesday.

The Appellate Division's First Department threw out a single identity theft charge against Raphael Golb, but preserved convictions on several other charges accusing him of using phony emails to harass his victims with claims a prominent researcher had copied work from his father.

Golb, 50, will continue to fight the convictions by asking the state's highest court to review the case, said defense attorney Ron Kuby. The Manhattan district attorney's office declined comment.

The case stemmed from the ongoing discourse over the scrolls that were found in caves in Israel beginning in the 1940s and contain the earliest known versions of portions of the Hebrew Bible.

Some scholars, including New York University Judaic studies chairman Lawrence Schiffman, say the texts were assembled by a sect known as the Essenes. Others ? including Norman Golb, a University of Chicago historian and Golb's father ? believe the writings were the work of a range of Jewish groups and communities.

Schiffman went to authorities after some of his students and colleagues received emails from an address that used his name. The fake emails had him admitting that he plagiarized Norman Golb's work and asking the recipients to keep quiet about it.

Raphael Golb, a literature scholar and real estate lawyer with a Harvard Ph.D. and an NYU law degree, acknowledged during his trial that he wrote the messages. But he said he never intended for anyone to believe Schiffman actually sent them, calling them "satire, irony, parody."

Prosecutors argued Golb's activities weren't commentary, but "thousands of hours of malicious harassment and impersonation." Golb also was convicted of opening up email accounts in the names of other scrolls scholars besides Schiffman.

Golb had asked the appeals court to overturn his conviction partly on the grounds that his emails were protected by free speech rights.

The court found that the First Amendment "protects the right to criticize another person, but it does not permit anyone to give an intentionally false impression that the source of the message is that other person."

It added that Golb also gave up his constitutional protections by intending "to cause harm ... including damage to the careers and livelihoods of the scholars he impersonated."

Internet impersonation claims have generated a number of lawsuits, but prosecutions are unusual unless phony identities are used to steal money, experts say.

In one notable case, Missouri mother Lori Drew was accused of helping her daughter and a friend pose as a teen boy on MySpace to send hurtful messages to a 13-year-old neighbor girl. The girl committed suicide.

A federal jury in California, where MySpace has its servers, convicted Drew of misdemeanor counts of accessing computers without authorization. A judge overturned the verdict and acquitted her.

Golb remains free on bail as he pursues his appeal.

Suicide bomber kills 2 at Somali president's villa

MOGADISHU, Somalia (AP) ? A suicide bomber detonated explosives outside the prime minister's home in Somalia's presidential palace compound, killing two people, an official said Tuesday.

The man blew himself up Tuesday morning when he was questioned by soldiers manning a checkpoint in the palace complex known as Villa Somalia, said Mohamed Ali, a police officer at the official residence in Mogadishu, the capital.

Villa Somalia has a large compound with several buildings and checkpoints. The bomber was four more checkpoints away from President Hassan Sheikh Mohamud's home, Ali said. The president is said to be out of the country on state business.

The checkpoint where the blast took place is near the home of Prime Minister's Abdi Farah Shirdon which is also in the compound, according to officials.

Shirdon was at home but was not harmed, according to an official from the palace who insisted on anonymity because he is not authorized to speak with the press.

Shirdon later released a statement read by Somalia's information minister saying one soldier was killed in the attack and the attacker is believed to be an operative of the al-Qaida-linked al-Shabab insurgent group.

"This inhumane and barbaric attack shows once again the cruel twisted ideology of killing and destruction by the al-Shabab," Shirdon said.

However, a military officer at the palace, Yusuf Abdi, said two soldiers died and three others were wounded in the explosion, backing what Ali had said.

"He killed two people and himself on the spot, his evil attempt has failed," Ali said.

Al -Shabab has opposed President Mohamud's election and government, saying it had been manipulated by western powers.

The president survived an assassination attempt on his second day in office in September when two suicide bombers blew themselves up while trying to gain access into a heavily guarded hotel serving as his temporary residence.

Mohamud, 56, who was an academic and activist before becoming president, is expected to form the county's first functioning central government since 1991, when warlords overthrew longtime dictator Mohamed Siad Barre.

Since 2004, Somalia has been represented by a U.N.-approved leadership structure called the Transitional Federal Government that until recently only controlled small parts of Mogadishu. That government accomplished little, but since African Union and Somali troops pushed the al-Shabab extremists out of the capital in 2011 and most parts of the country they occupied in 2012, positive momentum new stability is building.

Al-Shabab militants, though evicted from Mogadishu, still penetrate the seaside capital to carry out suicide attacks.

The international community is supporting Mohamud's government saying it's a step toward moving the country out of its failed-state status but that much more remains to be done in a country bloodied by two decades of war.

In a sign of progress, the United States last week officially recognized the Somali government for the first time since Barre's fall 1991.

Mohamud faces an uphill task unifying a fractious country in the face of the Islamist radicals' insurgency and rebuilding a bombed-out infrastructure, food security and institutions. Another challenge is fighting the endemic corruption that plagued previous governments.

Size

Prepare to read this in your best Carrie Bradshaw voice: When it comes to home desirability, does size matter? The answer, like most things, is not really. While San Francisco?s population is slightly larger than Baltimore?s, at 812,826, compared to 619,493, it is geographically much smaller, at 46.87 square miles compared to Baltimore?s 80.94. Because it is so small geographically, but has such a large population, housing in San Francisco is in high demand and is often stacked (more on that later). As Landon Nash, a Redfin Agent in San Francisco remarked, ?San Francisco is considered a ?big city? yet it is only 7?7 miles, which makes every corner of the city easily accessible. Whether you want to head to Baker?s Beach, Golden Gate Park, or Dolores Park everything is a quick jaunt away. It?s hard to imagine a better place to live.?

Median Household Income

The median household income in San Francisco is $72,947, and in Baltimore it?s $40,100. Surprisingly, the main industries are very similar? while Bethlehem Steel was once a major employer in Baltimore, now key industries include financial services, trade/shipping, technology, and healthcare. Although manufacturing plants are no longer major employers, Baltimore is proud of its past. As Redfin Agent Taylor Connolly notes, ?We?re a gritty city that?s proud of our blue collar roots! Only in Baltimore would we be proud of the show, ?The Wire.? Our engineers are building bridges not software.?

Education

In San Francisco a little more than half of the population over the age of 25 have a bachelor?s degree or higher. In Baltimore that number drops to 25.8%. ?San Francisco is the young professional?s playground, with a bustling economy that gives you access to the entire bay area,? said Landon Nash, Redfin Agent. ?You work hard and either play hard or relax hard.?

Median Single-Family Home Price

The median price of a single family home is a jaw-dropping $822,000 in San Francisco. Meanwhile, in Baltimore, it is $145,000. When you compare that to the median household income noted above, you can see that it doesn?t scale. Not surprisingly, few people can afford to own a home in San Francisco?

Homeownership Rate

With the price of homes so high, only 37.1 percent of the population in San Francisco owns a home, while in Baltimore nearly half ? 49.5% ? of the population owns a home. What kinds of homes do they live in? Well, condos?

Housing units in multi-unit structures

With so many people in such a small geographic area and housing costs so high, the majority (67.3%) of homeowners in San Francisco live in a multi-unit structure, i.e. condos and townhomes. In Baltimore, the majority of the population (67.2%) lives in single family homes. Ravens fans chant ?protect this house, I will,? but in San Francisco they?d have to chant ?protect this multi-unit apartment building, I will.?

Homes for Sale

As of January 24, 2013, there were only 375 homes on the market in San Francisco. With a population over 800,000, that?s an astonishingly small number. Meanwhile, in Baltimore, there are 2,709 homes on the market. This leads us to our next point?

Bidding Wars

Bidding wars are the norm when trying to purchase homes in San Francisco. We crunched the numbers and determined that in the last four months, 78% of all offers that Redfin Agents wrote went into bidding wars. In Baltimore we saw bidding wars with only 34% of the offers, so if you?re buying in Baltimore you might have a better chance of securing your first choice home.

Homes Sold in 2012

Despite Baltimore?s smaller population size, more homes were sold there in 2012. There were a total of 6,751 homes sold in all of 2012 in San Francisco, compared to 10,975 homes sold in Baltimore. With such a competitive market in San Francisco, people are staying put once they find a home.

Homeowner Vacancy Rates

The U.S. Census tracks homeowner and rental vacancy rates ? essentially the number of empty homes in the area. The data is often used by public and private organizations to evaluate the need for new housing programs and initiatives, and it is indicative of job losses and foreclosures. In the third quarter of 2012, only .5% of all homes were vacant in San Francisco, and in Baltimore that number was 1.3%. With land value so high in San Francisco, it makes sense that there would be fewer abandoned homes, although foreclosures are definitely one reason why homes would be empty. After the close of Bethlehem Steel in 2003, many people moved out of Baltimore, leaving empty houses behind, which is why the number might be higher in Baltimore.

A 'tough but fair' path to citizenship

A bipartisan group of eight senators unveiled a new immigration reform proposal Monday that would allow most of the estimated 11 million illegal immigrants currently living in the country to eventually become citizens.

The senators unveiled details of the proposal during a press conference Monday afternoon, calling it a "tough but fair" way to reform the nation's immigration system for the first time since 1986, when President Ronald Reagan signed into law a bill that legalized nearly 3 million immigrants.

"We still have a long way to go, but this bipartisan blueprint is a major breakthrough," said New York Democratic Sen. Chuck Schumer, who added that they plan to have a bill officially introduced by March and passed through the Senate by "late spring or summer."

The senators, who have been meeting about the issue behind closed doors since December, include Republicans John McCain of Arizona, Marco Rubio of Florida, Jeff Flake of Arizona and Lindsey Graham of South Carolina, and Democrats Michael Bennet of Colorado, Dick Durbin of Illinois, Robert Menendez of New Jersey and Schumer.

Since the presidential election, in which more than 70 percent of Hispanic voters supported President Barack Obama's re-election, the appetite in Washington for comprehensive immigration reform has increased for both parties. The senators behind the effort believe they have a window of opportunity to pass a bill, even though similar efforts failed many times in the past.

"For the first time ever, there's more political risk in opposing immigration reform than supporting it," Schumer said at the press conference. "We believe we have a window of opportunity to act."

McCain, who led the Republican side of failed bipartisan reform efforts in 2006, pointed to Republican fear of losing Hispanic support as a source of hope to secure passage of the bill. "The Republican Party is losing the support of our Hispanic citizens," McCain said.

It still remains to be seen whether the senators' blueprint will clash with Obama's vision for reform, which he will announce Tuesday in more detail in an appearance in Las Vegas. The senators' path to citizenship for illegal immigrants is less direct and could take longer than what Obama has outlined in the past.

When asked why they unveiled their blueprint before the president's speech, the senators said they informed Obama over the weekend that they had reached an agreement. "We don't have much time. We came to an agreement this weekend and we wanted to move quickly," Schumer said. "It seems to me that the Senate is the most fortuitous place to move forward first."

The senators' plan puts forward several hurdles before undocumented immigrants could obtain permanent residence visas, called green cards, which is the first step towards citizenship.

First, immigrants would apply for temporary legal status by registering with the government, completing a background check and paying a fine. Before any immigrant could obtain a green card, "a commission comprised of governors, attorneys general, and community leaders living along the Southwest border" must recommend that the government has taken enough steps to beef up border security and has also implemented a system that tracks when temporary visitors have left the country. It's unclear how long that would take, especially since border state governors are divided on how secure the border is now and ideally should be in the future.

The plan also says that no undocumented immigrant would receive a green card until every legal immigrant who is currently waiting for a green card has already received it. Wait times for green cards can be as long as 20 years in extreme cases, depending on whether the applicant is being sponsored by an employer or a family member. Family-based immigration, especially when a U.S. citizen is attempting to sponsor his or her sibling, can have especially long wait times.

The blueprint says the senators want to reduce these wait times and drastically increase legal, high-skilled immigration, so it's possible that the bill could expedite the process. If not, illegal immigrants seeking a green card could be waiting for decades.

The plan also excludes the children of illegal immigrants, commonly referred to as "Dreamers," as well as agricultural workers from the long wait for a green card. To prevent future illegal immigration, the blueprint also calls for a mandatory employment verification system.

Obama's blueprint asks for a wait time of eight years before illegal immigrants could get green cards, during which time they could live and work legally in the country. After five years with a green card, immigrants could apply to become citizens.

Speaking on the Senate floor before the announcement, Majority Leader Harry Reid praised members of the committee for proposing an outline for an immigration overhaul and said he would do "everything" in his power to ensure an immigration bill passes through the upper chamber.

"Nothing short of bipartisan success is acceptable to me," Reid, a Democrat from Nevada, said. "There is no reason why we should not pass comprehensive immigration reform immediately."

Immigration advocates, who generally favor a fast path to citizenship for the country's illegal immigrants, mostly praised the senators for adding to the "momentum" of reform, but did not comment on the specifics of the plan.

"Creating a 21st century immigration process won't be easy, but the framework the senators are proposing is a powerful and practical start to the legislative process, and it will make the peaks and valleys ahead much easier to traverse," said Ali Noorani, executive director of the the National Immigration Forum, in a statement.

But Chris Rickerd, policy counsel at the American Civil Liberties Union, said his organization has "concerns" that the lengthy time frame and fine might discourage people from applying to legalize. Rickerd also noted that some people might be excluded from legalization because they were prosecuted for immigration-related crimes in their states. For example in Arizona, illegal immigrants can be charged with "self smuggling," which is a felony that does not exist in other states.

Groups that favor less immigration, meanwhile, have blasted the plan as "amnesty."

"Like previous amnesty proposals, this most recent iteration creates a 'path to citizenship' for nearly all illegal aliens and offers empty promises of enforcement without providing any concrete details," said the Federation of American Immigration Reform in a statement.

The senators unveiling the blueprint conceded that there would be much work ahead transforming their outline of ideas into the law, but expressed optimism that, unlike past attempts, there would be enough will between both parties to pass a comprehensive bill.

"It won't be easy," Durbin said. "It will take them time and determination."

Organic solar cells are made with the so-called organic elements ? carbon, oxygen and nitrogen ? and are cheaper to make, lighter and more flexible than the traditional silicon cells available in solar panels today.

Organic cells aren't as efficient at turning the sun's energy into electricity as silicon cells, however. Many research groups are working to improve organic solar cells' efficiency. If they work well, such cells could go into? electricity-producing windows ?or clothes.

In their work, the Northwestern researchers focused on the top layer of an organic solar cell, called the scattering layer, which traps photons from sunlight. They wanted a scattering layer that would hold photos for a greater amount of time.

"We wanted to determine the geometry for the scattering layer that would give us optimal performance," Cheng Sun, a mechanical engineer and one of the creators of the new organic solar cell,? said in a statement. "But with so many possibilities, it's difficult to know where to start, so we looked to laws of natural selection to guide us."

Sun and his colleagues' program simulated more than 20 generations of matings to come up with their final design. The program also mimicked the biological processes of mutation and an exchange of traits called crossing over.

The resulting design traps photons for three times as long as the Yablonovitch Limit, which describes how long a photon is likely to stay in a semiconducting material. Researchers have only been able to reach and break the Yablonovitch Limit in the last few years.?

The engineers? published their work ?Jan. 3 in the journal Scientific Reports.

Facebook took another step toward becoming its own web universe when it launched a search engine for shared content. This move challenges the future relevance of search engines like Google, as well as review sites such as Yelp and Foursquare.

The aim of ?graph search? is to assist the Facebook community in finding information more easily about what other Facebook users have shared on the network. It uses the indexed information generated within the Facebook universe to generate search information. It will allow people to find others by their interests, location or career. So if you like water skiing you can find other people that live nearby that also like water skiing, which will in turn allow you to make new connections with other people who share similar interests with you. Alternatively you can search for people nearby who like Chinese food and see what restaurants they have ?liked,? and read their comments.

This graph search engine is designed to give Facebook users the ability to sort information by topics and interests with the added advantage of keeping its users within the Facebook community instead of sending them to search engines or review sites for the information they seek. "Graph Search is designed to take a precise query and return to you the answer, not link to other places where you might get the answer," Mark Zuckerberg explained, highlighting some of the issues of a typical Web search.

Graph Search (beta) version rolls out Tuesday on a limited basis to users. This version will be able to handle queries based on people, photos, places and interests.

It is anticipated that results will be displayed based on importance, so a restaurant with more likes could possibly show up toward the top of the list that is generated by the search. Check-ins could also have an impact on where a place is positioned on the list, emphasizing the importance and need for businesses to be actively involved on Facebook and ensuring that their Page is relevant, engaging and up-to-date.

Facebook also partners with Microsoft's Bing social search engine to fill in some of the gaps where Graph Search cannot supply the information. Facebook does stress that Graph Search is not a web search, but this can be seen as the first step in that direction, because when the product is fully operational it will give many Facebook users an incentive to stay within the Facebook community instead of spending time on other social media and search sites.

BARCELONA, Spain (AP) ? Lionel Messi scored four goals to become the youngest player to pass the 200-mark in the Spanish league and set a La Liga record with goals in 11 consecutive games, leading Barcelona to a 5-1 rout of Osasuna on Sunday night.

With his 22nd hat trick for Barcelona and fifth game of four goals or more, Messi increased his La Liga total to 202 goals in 235 games. The 25-year-old became the eighth player to reach 200, joining Telmo Zarra (251), Hugo Sanchez (234), Raul Gonzalez (228), Alfredo di Stefano (227), Cesar Rodriguez (223), Quini (219) and Pahino (210). Zarra had been the youngest to reach 200, achieving the feat when he was 29.

Messi has 44 goals this season, including 33 in La Liga. He has scored in his last 16 starts overall and in a record 11 consecutive La Liga games, breaking the mark he tied last season. Mariano Martin (1942-43 to 1943-44) and Brazil's Ronaldo (1996-97) also accomplished the feat, both for Barcelona.

LONDON (AP) ? Liverpool and Tottenham lost to lower-league opponents in the FA Cup on Sunday, joining a lengthy list of Premier League teams to exit in the fourth round of soccer's oldest knockout competition.

Yandex launches Wonder, a voice-controlled social search app for the US market (update)

Yandex, the Russian search giant, has just launched its first product for the US market: a voice-controlled social search app called Wonder. Available on iOS, the app pulls data from your Facebook, Foursquare, Instagram and Twitter accounts to answer questions like "What music do my friends listen to?" Essentially, it's a mobile version of Facebook's new Graph Search, which also uses data from your social network contacts to answer questions. Wonder uses Nuance's speech-recognition tech to record and convert your words into text, and Yandex's own language software then processes those words (you can also type your queries, if you're so inclined). According to TechCrunch, which spoke with the company about the new app, Wonder is launching as a "pure experiment," with the intent to collect feedback as well as data from English-speaking users. Currently, the app is only available in the US, and it only supports questions about places, music and news. If you're packing an iDevice, you can click through to the App Store to download Wonder for free. Make sure to check out a video demo past the break, too.

Update: Facebook has thrown a spanner in the works, preventing the new app from accessing its API. The two sides are now discussing a way out of the impasse, which would need to meet Facebook's requirement that outside search engines only access its data with written permission. Bill Macumber Case Legal Technicalities - Business Insider

Barry Siegel's book "Manifest Injustice" chronicles the saga of Bill Macumber, who was falsely was imprisoned for 37 years for the murder of two people in Scottsdale, Ariz.

What's most galling about this tragedy is that it could have been avoided if not for a legal technicality.

A man named Ernest Valenzuela had confessed the crime to his attorney?before later dying in a prison fight. The attorney's testimony could have vindicated Macumber. Instead, a judge protected the attorney-client privilege of the dead man and let the innocent man go to jail.

When Macumber came to trial in 1975, Valenzuela's former public defender Thomas O'Toole wrote to the trial judge asking to testify about his now-dead client's confession.

However, Judge Charles Hardy wouldn't allow the confession to be heard.

"Let the record show the Court has ruled that the proffered evidence isn't admissible," Hardy said in his ruling, according to the book. "First because the communications to Mr. O'Toole and Mr. Petica [another of Valenzuela's defense attorneys] were privileged because of the attorney-client relationship. There's no waiver of the privilege."

After Macumber was sentenced to life behind bars, his defense team appealed the case all the way to the Arizona Supreme Court.

The state Supreme Court ultimately gave him a retrial because of issues with ballistics evidence.

But in its ruling granting him a retrial, the Arizona Supreme Court ruled the trial court could still "assert" the attorney-client privilege on behalf of the dead man and exclude his testimony if it wanted to.

But yet again, the court ruled against Macumber, with Judge Robert Corcoran saying attorney-client privilege prevented the testimony. Macumber was convicted a second time.

After reading the book, we were shocked that a dead man's rights would supersede those of a living man who was fighting for his life.But according to legal ethics expert Andrew Perlman, who teaches procedure and professional responsibility at Suffolk University Law School, the court made the right decision with respect to the law.

"It is not shocking to me that a court would uphold the privilege here, even though doing so might have produced an unjust outcome in this particular case," Perlman said in an email to Business Insider. "The problem is that if courts reject the privilege any time it might be perceived as necessary to uncover the truth, clients would become quite concerned about sharing any information with their lawyers. Although I believe that there should be an exception to the duty of confidentiality to permit lawyers to disclose information necessary to prevent the wrongful execution or incarceration of an innocent person, I am not convinced that such a disclosure should have the effect of waiving the attorney-client privilege."

Macumber was?released from prison in November 2012 after the Arizona Justice Project got involved and filed motions that successfully questioned the judges' decisions to not allow Valenzuela's testimony, The Republic reported at the time.

During the weeks the kids are off on holidays, or on weekends, why not participate in free outdoor activities like sliding at a local public hill, skating at a local public rink or even look into free winter festivals that may be taking place in your neighbourhood. These activities keep everyone happy and won't make an impact on your already dented budget.?

If you live in a close-knit neighbourhood you can also invite the local kids together for a snowman parade. This is where kids build snowmen and parade them around the block in a wagon or sled. Maybe even have a judging contest (of course everyone would win, it's all for fun after all).

Workout at home:

There's no need to keep up with the?Jones'?and spend on a gym membership this year. You can get a simple workout right at home. If you're willing to tough it outside a brisk walk, run or snowshoe could be the best workout you have all year. Best of all these activities cost you nothing but time and energy, if you want to work off that post-holiday overindulgence, these are great starting points. In winter months it can even be fun to get a group of friends together and share winter workout gear or workout music playlists to help eachother get motivated to meet their workout goals. With the money saved, you could all enjoy a nice hot chocolate or late for a treat afterward.?

Cold water wash:

No matter what the season, I wash our laundry in cold water. It saves money on electricity, use of hot water and also not as hard on the clothing. Less chance of shrinking that new sweater mom got me for Christmas. Using cold water and detergent like Cold Water Tide can actually save about $7 a load in energy costs. With the amount of laundry we do per week - those savings can definitely add up!




Winter Staycation:

Want to take the family on a vacation on an already tight budget? Why spend hundreds on a vacation somewhere hot and balmy when you can save money on a staycation right in your own city! You'd be surprised how fun and inexpensive a staycation close to home can be. Local hotels, restaurants and attractions often have off-season discounts you can cash in on. Just do a little research about where you're heading and call in advance letting them know about your local staycation to see if they have any discounts and savings you could use for your family. Being local you may just find a cheap hotel room rate or family meal discounts in hotels and restaurants!?
